Literature Review on Metamaterial LITERATURE REVIEW ON METAMATERIAL The Left-Handed Metamaterial (LHM) has a few unique properties such as negative refraction and backward wave. In this chapter, the basic theories behind their unique properties are presented and some applications of LHM toward the antenna application are discussed. DEFINITION BACKGROUND OF LEFT-HANDED METAMATERIAL Electromagnetic Metamaterial can be defined as artificial effective homogenous electromagnetic structures with unusual properties not readily found in nature . A Left-Handed Metamaterial (LHM) [17][18]or Double Negative Metamaterial (DNG) is an electromagnetic Metamaterial that exhibit negative permittivity and permeability. This phenomenon can be characterized by the negative refraction index and the anti-parallel phase velocity which is also known as backward wave. HISTORY OF LEFT-HANDED METAMATERIAL (LHM) The initial work on LHM was started by V. G. Veselago from the Lebedjev Physical Institute in Moscow when he made a theoretical speculation of this artificial material that exhibit negative permittivity and negative permeability. Veselago speculation remain silent for 29 years until 1996, J. B. Pendry from Imperial College London and his co-author form GEC-Marconi published a paper about artificial metallic construction which exhibit negative permittivity and negative permeability. Following this interesting discovery, in 2001, the first experimental verification was made by Shelby, Smith and Schultz at the University of California. The left handed material structure consists of split ring resonator and thin wire inspired by J. B. Pendry as shown in figure 3.1. An approaching source will appear to radiate at a lower frequency and charged particles moving faster than the speed of light in the medium will radiate in a backward cone, not a forward cone. LEFT-HANDED METAMATERIAL STRUCTURE The first LHM structure consists of split ring resonator (SRR) and thin wire (TW) or capacitance loaded strip (CLS)[19]. The SRR exhibits the negative value of permeability and the CLS and TW exhibit the negative value of permittivity in a certain range of frequency. If the excitation of the magnetic field is perpendicular to plane of the structure, this will generate the magnetic dipole moment. The SRR is a highly conductive structure in which the capacitance between the two rings balances its inductance . The SRR induces high current density structure which creates a large magnetic moment. CLS and TW would produce strong dielectric like response. As electric field propagates parallel through the TW or CLS, it will induce a current along them. This will generate an electric dipole moment to the structure and exhibit a plasmonic-type of permittivity frequency . CST SOFTWARE CST was founded in 1992 byThomas Weiland. It simplifies the process of inputting the structure by providing a powerful solid modeling front-end which is based on the ACIS modeling kernel. After the component has been modeled, a fully automatic meshing procedure (based on an expert system) is applied before the simulation engine is started. Abuse in Government Care      It is unfortunate that in our society some children grow up without the opportunity of having a loving family to raise them. More unimaginable is children growing up with parents or family members that are abusive. Children raised in abusive environments that are reported to social services and removed from their home are placed into foster care. Foster care is defined supervised care for delinquent or neglected children usually in an institution or substitute home set up by the government. Some advocates claim that the government child care system is adequate, but others like David Van Biema of Time Magazine state that, â€Å"foster care is intended to protect children from neglect and abuse at the hands of parents and other family members, yet all too often it becomes an equally cruel form of neglect and abuse by the state (Biema).†There is substantial research that looks deeper into the foster care system. It reveals that abuse in foster care is a big e nough problem that it needs to be addressed, but what changes can or should be made?      Government statistics, newspaper articles, and thorough research projects have been completed to answer the question, â€Å"is there a problem in the foster care system?†The results have revealed that a serious problem exist within foster care in the United States. At any given time there are approximately 542,000 children in the foster care system (Dept of Health). This number continues to rise each year. In 2001, 290,000 children entered into foster care, while only 263,000 children left the system (Dept of Health). Of the 263,000 children that left foster care in the year 2001, 31% were in care for over two years (Dept of Health). Nineteen percent of those children were in foster care for one to two years (Dept of Health). Two years is an unacceptable amount of time when taken into consideration that between the ages of 8 and ten are critical developmental years in a child’s life. The average age of the a child leaving the foster care system in 2 001 was 10.2 years old (Dept of Health). The amount of children per foster home at any given time is another problem. The average number of children per home in the foster care system is 3.7, which is up from 1.4 in 1983. Elephant was a movie based on an average high school In the last ten years, showing the experiences, different emotions and actions students have. While this movie In the end focuses on two boys, we see many different students throughout the movie and their part In high school. Even though this Is to be based on an average high school, I believe at times they showed an unrealistic portrayal on students and teachers with some of their actions in this movie.Not far into the movie they show a cone of girls in gym class, all wearing shorts outside except one, Michelle. Which is nothing wrong with that, but what happens is the teachers makes a comment on her wearing sweats, telling her she needs to Join the rest of the girls, by wearing shorts. Otherwise, by her not following these instructions, it would lead to a drop in her marks. Michelle to me seems like an insecure girl, not wanting to show her body off.And no school I feel would make girls who are insecure about their body have to f eel uncomfortable by wearing shorts, Just because every other girl in class was confident and wears shorts. I also found this movie made students look stupid, making them so oblivious to what was happening around them. As the two boys enter the school, stalking around the halls with those massive guns In their hands, you see not one student scream or even notice what was happening.Especially in the library which was full of kids, one of the boys marched right in, gun in the air, and it takes for him o actually shoot it after awhile for anyone to scream or run. Not to mention how as the shooting starts, students weren't even running out of the school. In so many of the scenes when you see students running away they completely ignore the doors as if they weren't even there. They Just run past or go up the stairs. No student would actually choose to run up a couple flights of stairs then to just run outside, getting away from this tragedy.

Ten Common Myths Regarding Teachers Teaching is one of the most misunderstood professions. Many people do not understand the dedication and hard work that it takes to be a good teacher. The truth is that it is often a thankless profession. A significant portion of the parents and students that we work with on a regular basis do not respect or appreciate what we are trying to do for them. Teachers deserve to be respected more, but there is a stigma associated with the profession that will not go away any time soon. The following myths drive this stigma making this job even more difficult than it already is. Myth #1 – Teachers work from 8:00 a.m. – 3:00 p.m. The fact that people believe that teachers only work Monday-Friday from 8-3 is laughable. Most teachers arrive early, stay late, and often spend a few hours on the weekend working in their classrooms. Throughout the school year, they also sacrifice time at home for activities such as grading papers and preparing for the next day. They are always on the job. A recent article published by BBC news in England highlighted a survey asking their teachers how many hours they spend on the job. This survey compares favorably to the amount of time teachers in the United States spend working each week. The survey evaluated the time spent in the classroom and the time spent working at home. According to the survey, teachers worked between 55-63 hours per week depending on the level that they teach. Myth #2 – Teachers have the entire summer off work. Yearly teaching contracts typically range from 175-190 days depending on the number of professional development days required by the state. Teachers generally receive about 2 ½ months for summer vacation. This does not mean they are not working. Most teachers will attend at least one professional development workshop during the summer, and many attend more. They utilize the summer to plan for the next year, read up on the latest educational literature, and pour through new curriculum that they will be teaching when the New Year begins. Myth #4 – Teachers want to eliminate standardized testing. Most teachers do not have an issue with standardized testing itself. Students have been taking standardized tests every year for several decades. Teachers have utilized testing data to drive classroom and individual instruction for years. Teachers appreciate having the data and apply it to their classroom. The high stakes testing era has changed a lot of the perception of standardized testing. Teacher evaluations, high school graduation, and student retention are just a few of the things that are now tied to these tests. Teachers have been forced to sacrifice creativity and to ignore teachable moments to ensure that they cover everything their students will see on these tests. They waste weeks and sometimes months of class time doing comprehension test prep activities to prepare their students. Teachers are not afraid of standardized testing itself, they are afraid of how the results are now used. Myth #5 – Teachers are opposed to the Common Core State Standards. Standards have been around for years. They will always exist in some form. They are blueprints for teachers based on grade level and subject matter. Teachers value standards because it gives them a central path to follow as they move from point A to point B. The Common Core State Standards are no different. They are another blueprint for teachers to follow. There are some subtle changes that many teachers would like to make, but they truly are not much different than what most states have been using for years. So what are teachers opposed to? They are opposed to the testing tied the Common Core. They already loathe the overemphasis on standardized testing and believe the Common Core will increase that emphasis even more. Myth #6 – Teachers only teach, because they cannot do anything else. Teachers are some of the smartest people I know. It is frustrating that there are people in the world that actually believe that teaching is an easy profession full of people that are incapable of doing anything else. Most become teachers because they love working with young people and want to make an impact. It takes an exceptional person and those who consider it glorified â€Å"babysitting†would be shocked if they shadowed a teacher for a few days. Many teachers could pursue other career paths with less stress and more money, but choose to stay in the profession because they want to be a difference maker. Myth #7 – Teachers are out to get my child. Most teachers are there because they genuinely care for their students. For the most part, they are not out to get a child. They have a certain set of rules and expectations that every student is expected to follow. The chances are decent that the child is the issue if you think the teacher is out to get them. No teacher is perfect. There may be times that we come down too hard on a student. This often results out of frustration when a student refuses to respect the rules of the classroom. However, this does not mean we are out to get them. It means that we care enough about them to correct the behavior before it becomes uncorrectable. Myth #8 – Teachers are responsible for my child’s education. Parents are any child’s greatest teacher. Teachers only spend a few hours each day over the course of a year with a child, but parents spend a lifetime. In reality, it takes a partnership between parents and teachers to maximize a student’s learning potential. Neither parents nor teachers can do it alone. Teachers want a healthy partnership with parents. They understand the value that parents bring. They are frustrated by parents who believe they have little to no role in their child’s education other than making them go to school. Parents should understand that they are limiting their child’s education when they do not get involved. Myth #9 – Teachers are continuously opposed to change. Most teachers embrace change when it is for the better. Education is a continuously changing field. Trends, technology, and new research are continuously evolving and teachers do a decent job of keeping up with those changes. What they fight against is bureaucratic policy that forces them to do more with less. In recent years, class sizes have increased, and school funding has decreased, but teachers are expected to produce greater results than at any time. Teachers want more than the status quo, but they want to be properly equipped to fight their battles successfully. Myth #10 – Teachers are not like real people. Students get used to seeing their teachers in â€Å"teacher mode†day in and day out. It is hard sometimes to think of them as real people who have lives outside of school. Teachers are often held to a higher moral standard. We are expected to behave a certain way at all times. However, we are very much real people. We have families. We have hobbies and interests. In the period between 2000 and 2002, all the fees paid by General Electric to Auditors (in millions), except the financial information systems fees took an upward trend. The audit fees increased by $14.8 while the audit-related fees and the tax fees increased by $7.8 and $7.4 respectively (textbooks.com). After the implementation of the Sarbanes-Oxley, the figures increased still but not uniformly as before. The audit fees and the audit related fees rose significantly between 2004 and 2008 and then dropped to in 2010. The increment is however not bigger than the change in the tax fees, which were reduced drastically after the implementation of the Sarbanes-Oxley. Taking a similar analysis for the Fortune 100 companies yields even more interesting comparison. The Standing Committee for Youth Justice (2010) reported that during the period of 1989 to 2009, the child custody population in England and Wales increased by 795%. There is no obvious evidence showing that the youth crime become more serious recently, but more young people was sent to prisons. These large amounts of young prisoners have already brought a big pressure to the prison system, and it has become an alarming issue in England and Wales. The prison lives are much more badly than we imagined. They are neglected from the society, some of you may say they are put in the prison because they commit crime, it is fair enough. Incarceration of offenders may have deterrence effect as they will not further commit crime in the future, but the truth is the reoffending rate still stays high. For this, I always doubt Do we need to incarcerate all under-age offenders? and Do prisons work for all offenders?. Prison may cause more personal and social problems that we never expect. Also, children who sentenced to prisons have their own problems or difficulties before they getting sent to prison, it may include poor family backgrounds or drugs abuse, etc. These make the prison system more difficult to handle these children, and thus causing the problem of resources and management. Many concerning parties are doing different reforms as they want to reduce the number. Prison Reform Trust is one of the charities who promote alternatives to custody. It has launched a new campaign Out of Trouble especially helps those children and young people who are imprisoned in the UK. Also, the United Nations Convention on the Rights of the Child Article 36(d) stated that custody be used as a last resort. However, Prison Reform Trust criticized the juvenile court doesnt follow it strictly. Everyone understands that the statuses of children and adult are different, it is assumed that child should have more chance than adult. Children are important capital to our future society, so the prison system has greater responsibilities to help those youth offenders a better future. Under this perspective, people always argue about the purpose of imprisoning a child should be different from the adult one too. Society always place greater hope on these groups of vulnerable children. No matter the society, professionals or the government, they will put greater emphasis on rehabilitation rather than punishment, but the problem is how to make a balance between punishment and rehabilitation? The first thing to concern about is resources, thats the money-cost. Many news reports complained that youth custody spent too much but with an unpleasant outcome in return. Every year many millions of pounds are wasted for locking up children for committing both violent and non-violent offences, it is extremely costly but fails to reduce the amount of crime. According to the report Punishing costs: How locking up children is making Britain less safe(2010), Aleksi Knuutila stated that holding a child in prison costs about  £100,000 a year in England and Wales. Prison Trust Reform always argues that some very minor offences will result in custodial sentences, and they state that non-violent crime offenders should not be sentenced to prison as it is a waste of resources. However, the Independent Commission on Youth Crime and Antisocial Behavior (2010) showed a disappointing result of reconviction rate, three quarters of all young people leaving custody re-offend within a year which means almost three out of four young offenders reoffend within a year after they release. We have already paid many millions for these youths, but we just did very little to change their behavior and protect the society. Except the money cost, we can see that the present system has limit ability to help these vulnerable child back to the right tracks. At first, people believe harsher punishment can help to deter them from doing further criminal behavior. But the truth is that the lives in prison make youngsters get closer to crime, or even breeding them into professional criminals. This is one of the struggle points for the prison system to manage and allocate those youngsters in the right places. The prison system also needs to try their best to ensure that children in prison still have their proper lives, which include giving them educational support and mentally support. As children are valuable capitals to our future society, although they did something wrong, they still have the chance to learn. Education is important to youngsters at any places, this can help youngsters to build up different kinds of skills and abilities, thus integrate back to normal life easier when they release. Most of the public support that youth institutions should give education and training to the children in prisons, this places great pressure on the prison system yet they have already put a lot of resources in providing children different education and training inside the prisons. Moreover, there is still statistics showed that the prison system is not doing enough for the children. According to the report Training planning for children and young people (2010), it stated that prisons are failing to adequately prepare young people for release. One of the problems is that there is lack of accredited offending behavior programmes for the young prisoners. Even those young prisoners set up some targets for their training plans, they may not find suitable programme to achieve them through the imprisonment period. Also, it is reported that many children release from prisons till have difficulties in their learning. This showed that the prison system doesnt spend well, and they cannot learn what they should learn in the prisons. Special attention should also be put on childs psychological needs. Inside the prison, juvenile will be allocated into different cells. It is not easy to adapt the prison lives, and it may cause them different psychological problems, such as depression. The Standing committee for youth justice report (2010) stated that Boys in custody are 18 times more likely to suicide than children in the community. We can see that it is a serious problem inside the prisons. However, it is not possible for all prison officers to have specific training to handle these problems. If the problem is ignored for a certain period of time, it may cause them suffer from some more serious mental problems. Handling the psychological needs of offenders has become one of the responsibilities of the prison system, but resources are limited for them. Again, it places greater pressure on prisons work. Evidences of reconviction rate have also showed that the present prison system is failing to restore and rehabilitate children in their prison lives. The prison system should ensure the children learn from their mistakes and the moral values through their sentences. It is important for youngsters to understand what is right and wrong, and why they are punished, it can reduce the possibilities of reoffending. However, it may bring some negative effects to the child and society, and even cannot facilitate them in reintegration and rehabilitation. Organizations of protecting children always advocate the use of community sentences, for this, children can learn from community and learn in community. Community support is important to youth offenders, if they build up good relationship with the community, they can be integrate back into the community more easily. However, the prison system does not do much in this area and still has rooms for improvement. As mentioned above, youth prison is required to do differently. Not only punishing them for their wrongdoings, but to fix their brain. It is important to do more about rehabilitation, reformation and reintegration. Children are vulnerable and relatively inexperienced with the world, they are easily affected by the external factors. If child only arrange to do some routine works in prison, it is impossible for us to change their behavior. The system need to develop a different approach for them as it has greater responsibilities to restore and reform them. However, it is not a simple task. Setting up and working with a system which is different from the adult system, it has already made child in custody under 18 the most pressing issue in the prison system. Prison officers have many challenging works like providing children proper educational support in prison, taking care of child psychological needs, working with communities, doing work of rehabilitation, etc. All these work has given the prison system many challenges and making the child in custody under 18 becomes the most pressing issue in the prison system. Private Versus Public Education Many struggling parents wish they could send their children to private schools essentially from kindergarten through the twelfth grade. And so my question is: What is the real worth of a private education? According to a statement from the U.S. Department of Education posted by College Smart, private school students generally perform higher than their public school counterparts on standardized achievement tests. As a product of public elementary and high school education, I am currently seeing some of the struggles that public school students face after high school graduation when they enter college. I realize now that, behind the high tuition costs, private schools provide caring, challenges, and nurturing in an environment that is lacking in public schools. Families with resources inevitably send their children to private school. It’s what people in that social world do. Nevertheless, their reasons are not only because they can afford it, but also because the real wo rth of private education can be found in how those students more readily develop an awareness of academic excellence and high achievement. I have experienced all of the factors that constitute a free education. During my senior year at William L. Dickinson High School in Jersey City, New Jersey, I remember going to school for a half day, then going to work from 12:30 to 5 p.m. I would get home at six in the evening, Monday through Friday, and not have to do any homework; I loved the idea of having free time. Although I do not regret the corporate work experience, I see the consequences that leisure time brought into my life. Now that I am a college student, I am expected to be responsible for various assignments ... ...ter in life. The fact that I am a public school student does not blind me from seeing the reality of the bad habits that I developed through twelve years of two-hours maximum, and frequently no time, spent doing daily homework. I was not fortunate to attend a private school prior to Saint Peter’s College, and I am now suffering the consequences. Unlike public, private schools help promote good study habits that further a person’s chances of succeeding in college. According to College Smart, private school students are twice as likely as public school students to complete a bachelor’s or higher degree by their mid twenties (52 versus 26 percent). Therefore, the worth of attending a private school involves an education for the whole person within a values-based setting that begins with positive, committed habits that will carry over into the rest of one’s life.

Students and the Civil Rights Movement During the 1960s Essay
The 1960's was a decade of tremendous social and political upheaval. In the United States, many movements occurred by groups of people seeking to make positive changes in society. During this decade, the Civil Rights movement continued to gain momentum. The black community was continually persecuted and discriminated against by prejudice white individuals and figures of authority. Blacks everywhere struggled to end discrimination. They demanded the right to vote, to receive quality education, and to become respected individuals in the community which shunned them. (Sitkoff 35) Students, in particular, played a significant role in the Civil Rights Movement during the 1960's. Many college students were outraged by social injustices and the intolerance shown by their universities. Many individuals participated in boycotts and sit-ins in an attempt to change their community for the better. (Blumberg 18) The young people during the 1960?s greatly influenced the course of the Civil Rights movement by their efforts and actions. Students played a large role in the desegregation of both public grade schools and universities. College students also form ed and took part in new political groups such as the Black Panther Party and Students for a Democratic Society. (Blumberg 73) Because of their heavy political involvement in the Civil Rights Movement, students across the country created a new institution: the political university. (Curry 77) During the 1960?s, many student riots occurred on college campuses. The majority of the rioters were middle class students seeking a voice in the administration of their school. These riots were violent and sometimes fatal. A major issue during the Civil... ...fectiveness. The 1960?s were a time of great disorder among the young people of the America. Students began to stand up for their rights and fight to improve society, even if it meant turning their backs on the government. During the Civil Rights Movement of the 1960?s a new pattern was brought forth in many universities. The university was no longer just a community of learners and educators, but is suddenly became a political arena. But many tend to forget that the majority of the nations 6,700,000 college students were studying peacefully and not causing any trouble in the community (Curry 106). During this time, many changes were brought about in society, some being positive and others being negative. Because of their great passion and effort, students may be considered the most influential group of people during this critical period in history.

Orthodox Sacrament of Marriage Exchange of the rings Essay
There are different cultural rituals which are performed by people of different cultures. A cultural ritual refers to an event or activities that are valued within a certain group of people or society and which they relate with in a way that is unique from other communities. The cultural ritual that I was able to observe and take some notes was a wedding ritual under the Orthodox Church. The wedding ceremony is known as the â€Å"Orthodox Sacrament of Marriage†, and is primarily made up of two major parts. The part that got me fascinated was at the point where the couples are required to exchange the rings. The ritual, which took place just at the point of entry into the church, is considered to be special. It is taken to be the point at which the couples leave the world and transit into another world as they get into the church. The events that take place in this ritual include prayers for the couples by the priest as a way of blessing the union of the couple. It was observed that there artifacts which are needed and involved in the ritual. These include the rings which the couples put on their right hand. During one of the wedding ceremonies, it was noted that after the rings have been obtained, the next step that is taken after the couples have been blessed by the priest is the placement of the rings. The rings are not just placed on any finger or hand. The right hand is used to place the -295275-47625000rings. From what the believers say as it emerged is that, under the Orthodox wedding, the hand where the rings are place is the one that is believed to be used in making of promises and oaths, that is, right hand of the bride and that of the groom. It later also emerged that the right hand is used because it is the one which is used to recognize the presence of God Almighty. Quite interesting, or may be be cause it is believed such as in Christianity, the right hand is the hand of blessings. During the wedding, it was observed that when the couples were progressing with the wedding, it is that the right hand was the one used to make the sign of the cross. A cross from my view is a symbol of some sort of belief in a sect or religion. According to the faithful followers of this church, the sign of the cross is made as a way of recognizing that there was God in that ceremony. It is to be note that after placing a ring on the finger of the groom, a ring is then placed on the finger of the bride. From the wedding ritual, the artifacts, in this case the rings are of great significance and are greatly treasured. Without the rings, there cannot be a wedding and the priest is not allowed to give permission uniting the couples. The participants, that is, the bride and the groom are expected to know what placing the rings on their right hand means to them. Rings are a symbol of unity between the marrying parties as well as the families of the bride and the groom. The bride and the groom are required to know that they are leaving the â€Å"outside world†by standing at the entry to the church, and they are entering a â€Å"new world†, that of Christianity. The exchange of the rings by the couple illustrates their commitment not only to uphold the principles of the church but also to continue with the faith and belief of the church. The couples are united to each other as well as the church since the wedding takes place inside and outside the church, whereby the move from the outside to the inside of the church, symbolizing transformation of lives. The exchange of the rings however, only takes place after all the parties are asked questions on their commitment to the marriage and they make a promise. The bride first makes the promise after which the groom makes the promise. At this point, the priest is seen to be very keen on what the bride and groom say, may be for future reference in case the couple run in to marriage problems or issues that may require the intervention of the priest. Furthermore, the bride and the groom are expected to be aware that the placing of the rings on their right fingers signifies their agreement, betrothal, stewardship and authority towards each other. It is the belief of the participants that the rings represent their agreement, service to each other, commitment as well as authority in their marriage. The use of the rings in the ceremony means that the couples will always strive to support and be there for each other and that each of the two will gain from their union in marriage. The bride and the groom are expected to realize that when they exchange the rings, they have total commitment to each other and are bound to share as well as have an exchange of their spiritual belongs and their physical belongs till death separates the two. The love that they pledge to one another is expected to be eternal with full devotion and service to each other. Therefore, it is important that the groom and the bride understands what it mean by having the rings placed on their right hands during this ritual conducted at the entrance of the church with the help of a priest. The Orthodox followers shun marriages without weddings and one is shown great respect when they marry or get married through a church wedding. The family members are expected to be present during this time when the couples exchange the rings and the absence of one or both parents is considered as a curse. It is believed that failure of the parents to attend, if they are alive, means that the wedding is not blessed. The ritual of exchanging the rings at the entrance of the church is significant in the lives of the couple hence not taken lightly. The value that is placed on the exchange of the rings is noticeable even on the reaction that the bride and the groom display after the exchange of the rings. Joy and happiness is expressed through songs by the crowd that has attended the wedding as they exchange the rings. Generally, the wedding ritual of exchanging rings in the Orthodox Church is currently practiced even in other churches to signify unity of the couples. Gull Products INC. is a small business in Moose Jaw that supplies commercial products to other regional business. A big multinational corporation, Delnex, has moved into their area and could possibly represent one of Gull’s biggest customers. Phil, the sales supervisor and the key decision maker, leads the discussion on how to acquire Delnex as a customer. The sales team has four member; Bob, John, Cindy and Joe. Bob has the most experiences, John is a hard worker, Cindy is the newest member but has ties to Delnex from her old position, and Joe is their highest seller. Issues Elements of this case that are relevant to the course concepts are the; Team effectiveness Model, 5’s of Team Member Competency, Stages of Team Development. Issues and problems are that Phil is more focused on getting to play a round of golf. He doesn’t consider any other alternatives, which could result in Gull Inc. potentially resulting in not acquiring Delnex as a customer. Cindy’s idea is completely ignored and she is barely given a chance to speak. On top of that Phil called Cindy’s approach a ‘feminist’ way. External & Internal Factors External factors are the threat of other merchants approaching Delnex. Another factor is Delnex might not be interested in doing business. Internal factors are Gull Inc. culture and values from the top down, the competency of the sales reps. Another internal factor is equality; Phil should dismiss Cindy’s response in a feminist way. Analysis My first alternative is to take Cindy’s approach of an informative soft sell. Pros of this are their reputation and relationship with Delnex. A con of this approach is Cindy’s team members don’t value her opinion and not support her. Secondly they could take Joe’s approach and have an informal meeting on the golf course with Phil. A pro is they could be impressed by the private club and its ameniti.es and be swayed to do business with them. A con of this is there is no teamwork and Cindy is feeling invaluable and the feeling that none of her working companions respect her. Lastly, Gull Inc. could host Delnex with an informative presentation and a formal contract. This approach would require team collaboration from all members and improve teamwork and communication. This will make a good reputation with Delnex and build a solid relationship with Delnex leading to increased profits. Recommendation My recommendation is for Gull Inc. to host Delnex and have all the sales reps to communicate and collaborate their ideas into an informative presentation. This will impress Delnex and create a solid working relationship going forward and hopefully lead to increased profits. This will cause the greatest good for Gull Inc. and be the best way to acquire a contract with Delnex. Implementation Plan Phil needs to integrate the team and have them work together to create a presentation and formal contract as soon as possible to Delnex as soon as possible. Gull Inc. will host this presentation at one of their offices and have them sign a contractual obligation before they leave.

The employment relationship may be defined as the relationship between employer and employee over the terms and conditions of employment (Loudoun, Mcphail & Wilkinson 2009). In Australia, the industrial relations had become a big issue, so â€Å"following the 24 November 2007 Federal election, the Rudd Labor Government began work on its promises to re-shape Australia’s industrial relations system. †(Riley & Sheldon 2008) However, some people think that the state should stay out the employment relationship.This essay will argue that the state should stay in the employment relationship because it makes the roles and has the rights and responsibilities for the employee and employer in working environment. The state is an influential actor in employment relations (Bray 2012). It protects the employee and employer, set industrial disputes, establishes the health and safety standards, the minimum wages and maximum working hours. There is a large body of statute law (legislat ion) that regulates employment relations in Australia at both the federal and state level (Bray 2012).Such as Racial Discrimination Act 1975 and Sex Discrimination Act1984 for anti-discrimination, Common Law and Statute Law for the occupational health and safety (OHS). The main apparatuses of the state for employment relations are state and federal government departments, agencies, tribunals and courts (Loudoun, Mcphail & Wilkinson 2009). At federal level, the functions of a number of existing agencies and tribunals will be brought together in 2010 under one body known as ‘Fair Work Australia’ (Loudoun, Mcphail & Wilkinson 2009).Also there are some other organisations like Australian Industrial Registry, Work Choices, and National Employment Standards and so on. This essay will analyse two key arguments to explain why the state should stay in the employment relationship. Norris (as cited in Loudoun, Mcphail & Wilkinson, 2009, p. 225) states that discrimination occurs where members of one group of peo ple are denied opportunities to develop their capabilities and denied equal rewards for equal capabilities.In Australia, there are several kinds of discrimination such as age, gender, racial and disability. For these discriminations, the state enacted a range of anti-discrimination legislations which are supported by the federal Human Rights and Equal Opportunity Commission (HREOC) such as Age Discrimination Act 2004, Sex Discrimination Act 1984, Racial Discrimination Act 1975 and Disability Discrimination Act 1992. Age stereotyping appears to affect older people, whose situation receives much less attention than the problem of youth unemployment (Encel 1999). In Australia, age discrimination in working environment is alive and well.Research by Macdermott (2011) state that some state and territory legislation dates back almost two decades, and in 2004 the Australian Government enacted specific legislation outlawing age discrimination which is Age Discrimination Act 2004. By now, it has been operated for eight years and prohibits the discrimination on the basis of age. Recent research vindicates this prediction, demonstrating that women at all levels of management still report gender discrimination as a barrier to their advancement in Australia (Metz & Moss 2008). The gender pay gap is also reflected in the low numbers of women in leadership positions (Goward 2004).Therefore, the state enacted Sex Discrimination Act 1984 to assist the government for this issue. Under the Sex Discrimination Act it is unlawful to discriminate on the basis of gender, marital status, pregnancy and family responsibility (Loudoun, Mcphail & Wilkinson 2009). Racial discrimination includes race, colour, belief and national or ethnic origin. Australia is a multicultural country; a large number of people are from different countries. They have different cultural background like language, race, colour, belief and so on. Therefore, the racial discrimination has become one of the most serio us discriminations in Australia.For prohibiting it, Australia government legislate the Racial Discrimination Act 1975. Disability has many forms. According to Brazenor (2002), ‘a disability is defined as any limitation, restriction, impairment †¦ has lasted or is likely to last six months. ’ Loudoun, McPhail & Wilkinson (2009) also indicated that the unemployment rate for those with a disability (8. 6%) was higher than those without a disability (5%). The Disability Discrimination Act 1992 has already operated in many areas for several years and protected the rights of people who are disabled.Another prominent explanation for why the state should stay in the employment relationship is the health and safety. Mayhew and Peterson (as cited in Loudoun, Mcphail & Wilkinson, 2009, p. 257) defined OHS as the physical, physiological and psychosocial conditions of an organisation’s workforce, related to aspects of work and the work context. Health and safety is an em ployer’s duty that overrides all other management responsibilities. The role of effective OHS management is to improve OHS conditions and reduce risks that exist at a workplace (Loudoun, Mcphail & Wilkinson 2009).There are a lot of psychological and physical hazards in the workplace such as stress, chemical and biological agents and so on. For the OHS issue, there are two main parts of laws in legal regulation in Australia. Firstly is the Common Law. It is made by judge or court based on precedent. Under the Common Law, it involves Criminal Law which is initiated by the state and Civil Law that is initiated by an individual. The second part is the Statute Law which is made by the parliament. There are two main bodies of statute law in health and safety including Workers Compensation Law and Health & Safety Acts.The Workers Compensation Law aims to provide system of financial protection for all employers who suffer injury, illness or death due to work-related injury. The emplo yers will get paid even if it is not their faults. About the Health and Safety Acts, Its aim is to prevent workers being injured in the first place. However, the key concept of ‘duty of care’ emerged in common law, not statute law. In conclusion, because of the state makes roles for the employment relationships and protects the employee and employer’s rights, the state should stay in the employment relationship in Australia.This essay provided two key arguments to explain and prove the topic which were the discrimination and OHS in the workplace. For the discrimination in employment relationship, the state enacted a serious of Acts including Sex Discrimination Act, Age Discrimination, Racial Discrimination and Disability Discrimination Act. On the other hand, the state made a number of laws such as Common Law and Statute Law for the OHS issues in the workplace. Both two arguments are all relevant to today’s Australian workplace and expose concerning questi ons regarding the future.
